Why are we presenting you with these rules on the processing of personal data?

We have drafted these rules on the processing of personal data to clarify what we do to ensure that your personal data remain safe and confidential. The aim of this document is to provide you with information about the personal data we collect, why we collect it, how we use it, what sources we receive it from, what the purpose of collecting is, who we are permitted to provide the data to, and where you can get additional information about which of your personal data is processed and how it is secured.

All relationships which you enter into with us in connection with our employment services are governed by our General Terms and Conditions.

Please note that if you do not agree with the processing of your personal data or privacy policy, you cannot use our services.

If you have already used our services in the past, you are probably aware that we offer employment agency-related services personally or through our website www.grafton.hu, as well as through other ways, including partner websites or social media. This information sheet on the processing of personal data applies to any and all personal data which we collect through these platforms or by other means linked to these platforms.

The fact that we are a controller of personal data means that we respect the principles of personal data processing and treat your personal data solely in accordance with applicable laws, decide on the purpose and means of the processing your personal data, and ensure that your personal data is properly secured. We protect your personal data using state-of-the-art technology and we regularly evaluate and update our processes behind securing your personal data.

Why do we process your personal data?

Whether you are looking for a job, replying to a specific listing, creating a profile on our website, providing us with your CV, or contacting us for job information in other ways (electronically, in writing, on our recruitment form, by telephone, etc.), you are providing us with your personal data, which we process throughout the entire process of job placement and when providing our services. All of our services relate to job searching, the recruitment process, and personal development.

What personal data do we process?

We may process the following personal data or categories of personal data. This does not mean that we process all the personal data below for each candidate. For example, we are unable to fully list the personal data that job applicants submit to us in their CVs and other related documents. Please note that examples may not be exhaustive.

  • Name, last name
  • Academic title, education achieved
  • Permanent address, contact address
  • Country of citizenship
  • Date and place of birth, birth number
  • Native language
  • Phone number, email address
  • Expected remuneration / salary
  • Driver’s license
  • Information listed on your resume, your profile on our website, the attachments to your reply to the listing or your request for job information
  • Work experience / information about previous or current employment
  • Information about registration with the Labor Office
  • Photograph (if you provide it to us as an attachment to your CV)
  • Link to your profile on the social networks and their content
  • Information on commencing employment, amount of salary, termination of employment
  • Language skills, special skills/knowledge and professional qualifications
  • Assessment of personality characteristics

Why do we process your personal data?

We only process your personal data for legitimate reasons. Unless otherwise specified, we process the personal data of job applicants only with their express consent, or in connection with the performance of the contract concluded with us, as applicable. If we retain your personal data, e.g. due to legal dispute, such processing is based on our legitimate interest. Any transfer of candidates' personal data to our contractual partners who assist us with the recruitment of new candidates is based on our legitimate interests.

What purposes do we process your data for?

Processing your personal data enables us to facilitate activity as an employment agent and provide related services, which include, but are not limited to, the response to your employment application and correspondence between you and your potential employers during the recruitment process. We further process personal data for marketing and statistical purposes.

Personal data is collected to facilitate an effective recruitment process for applicants and clients when assessing your skills, experience, qualifications, and suitability for both existing and future jobs that may be of interest to you. In particular, we assess whether you are suitable for the job as a candidate and that your education, experience and language skills meet the requirements of the listing, and whether the remuneration is in line with your expectations.

Our website allows you to submit attachments with your application to a specific position. You submit these attachments on a voluntary basis, and the personal data contained in the attachments will be processed only for the purposes of assessing your suitability, as the candidate, for the position.

Your profile on our website allows you to link your job application with your social networking accounts (such as LinkedIn, Facebook). If you choose to provide a link to your social network account, we may process not only this link but also the data on your accounts, but only in connection with our activity as an employment agent.

Where do we get your personal data from?

We receive the majority of personal data that we process directly from you. Sometimes we also receive your personal data from third parties, e.g. from job applicant portals or from your previous employers, in cases when you have provided us with their contact information.

How long do we store your data for?

We only process personal data for the period of time that is necessary for the purpose for which we are processing it. Assuming you do not delete your profile or terminate your contractual relationship with us, we process your personal data for 5 years. When we find that your data is no longer necessary for any of the purposes for which it was processed, we discard it.

Who is your personal data transferred to?

Due to the fact that we process your personal data specifically for the purpose of our activities as an employment agent and to provide related services, we transfer your data to employers looking for employees to fill position listings. Personal data processed as per this information sheet may further be provided to authorized state authorities, institutions or other entities when the conditions specified by legal regulation are met. Should it be necessary to fulfill the purpose of processing personal data necessary for the performance of our legal obligations or our contractual obligations, should this be necessary to protect our legitimate interests, or should it follow from your consent, we may transfer your personal data to external suppliers, who support us during the recruitment process.

What are your rights?

You have the right to request information about your personal data and access it. You further have the right to ask us to correct or delete your personal data or to limit its processing. You may also object to the processing of your personal data or request the portability of the data. However, please note that we do not always have to comply with your cancellation, limitation, objection or portability request. Case-by-case reviews of our legal obligations and exemptions from these rights will be made.

Marketing communications

We may also use your personal data, among other purposes, to send you commercial messages regarding our employment agency services, both electronically and via SMS. We may use this data for these communications unless you (the addressee) have declined this option.

You have the right to decline receiving commercial messages at any time. You may do so via email, info@grafton.hu, through your profile, by following the link in a commercial message, or by sending a message to any of the contacts listed in these rules for the processing of personal data. You can do so also by filling out our contact questionnaire on Grafton website.

Not every message that we send you is a commercial message. We also use your contact information to communicate with you, e.g. when sending out information on changes to the General Terms and Conditions or these rules for the processing of personal data.

TERMS & CONDITIONS

 

1. Introduction

1.1. These General commercial terms and conditions (the “TC”) govern the relationship between Grafton Recruitment Személyzeti Tanácsadó Kft.)., with its registered seat at 1053 Budapest, Károlyi utca 12., ID No.: Cg.01-09-469247 (the “Company”) on the one side, and on the other by persons (the “Candidates”, or individually the “Candidate”), which use the webpage of the Company located at the address www.grafton.hu (the “Website”).

1.2. For the purposes of these TC, the Candidate is any natural or legal person, which uses these TC, regardless of whether it is registered at this Website. Using this Website for the purposes of these TC is defined mainly as inserting information to this Website, searching for information on this Website, processing information on this Website, and accessing this Website in an internet browser using any electronic device.

1.3. The Company reserves the right to update or change these TC, or to replace them completely with a new version of the TC. By using the Website, the Candidate agrees with the updated wording of the TC.

2. Security and use of username and password

2.1. The Candidate acknowledges that it is necessary to register in order to use the Website to its full extent. Should the Candidate decide not to register, the Candidate agrees to use a limited version of the Website.

2.2. When registering on the Website, the Candidate is required to fill out his / her identification and contact information in the extent of at least his / her name, surname, e-mail, telephone and address. The Candidate is also required to create a username when registering and enter a password that he / she will use for future logins (the "Login information").

2.3. Upon completion of the registration process, the Company grants the Candidate full access to the Website and creates a user profile for the Candidate (the "Profile"). The purpose of the Profile is to allow the Candidate to create a customized presentation on the Website for potential employers.

2.4. The Website allows the Candidate to add additional optional information to his / her Profile (CV, work experience, language skills, other skills, etc.) at the time of registering. By adding mandatory and optional information to the Profile, the Candidate agrees with their publication on the Website and he / she is responsible for their correctness and accuracy. The Candidate has the right to erase such data from the Profile at all time, or right to rectification should the data change.

2.5. The Candidate is fully responsible for ensuring the confidentiality and protection of the Login information. In particular, the Candidate is responsible for the fact that the login password will not be communicated to third parties and that the login password will be sufficiently resistant to cracking.
Should the Candidate’s Login information be compromised, the Company is not responsible for any misuse of the Candidate’s Profile on the Website. The Candidate acknowledges that the Company will never ask the Candidate to communicate his / her Login information.

2.6. Should the Candidate find that the Login information has been or could be compromised or misused, he / she is required to immediately change the Login information on the Website. Should this not be possible for any reason, the Candidate is required to contact the Company without any delay.

3. Rules for the use of the Website

3.1. The Company operates the Website for the purposes of providing services of arranging employment of Candidates (by recruiting, agency employment, talent management, etc.). The Candidate is not entitled to use the Website for other purposes.

3.2. The Candidate is required not to publish on or upload to the Website any information, materials, or documents which

            3.2.1. is not true, inaccurate, or otherwise misleading;

3.2.2. breach copyright or any other rights of intellectual or industrial property of any third party;

3.2.3. are offensive, threatening, obscene or could be otherwise interpreted by the Company or any third person as inappropriate.

3.2.4. could be considered as slander in the sense of Act C of 2012 on Criminal Code 226-227. According to § 2 of Act V of 2013 on the Law of the Civil Code, on Certain Wrongdoings, as amended, interfere with the personal rights of natural persons or the good reputation of a legal person, or otherwise in any other way breach Hungarian or foreign generally binding regulations;

3.2.5. may incite violence, or committing of other criminal offences or wrongdoings or lead to any harm to life, health, property or natural rights;

3.2.6. infect the Website with viruses, malware, bloatware or any other type of software which interferes with the effective operation of the Website, changes its content, or enables the unauthorized retrieval of information from the Website; or

3.2.7 requires the consent of third parties in order to be published on or uploaded to the Website, when this consent was not granted.

3.2. Should the Company find that any piece of data, material or document published on the Profile of the Candidate on the Website is in conflict with the rules listed in paragraph 3.2. of this article or are otherwise in conflict with these TC, the Company is entitled to remove this piece of data, material or document from the Website without any prior notice to the Candidate, or delete the Profile of the Candidate on the Website and thus prevent the Candidate from further using of the Website.

3.3. The Candidate acknowledges that should there be a breach of these TC or any generally binding regulations, the Company will fully cooperate with bodies active in the criminal process, or any other public bodies in order to identify the person who breached the TC or the generally binding regulations.

 

4. Intellectual property rights

4.1. Unless expressly specified otherwise, copyright and other rights of intellectual property regarding all the content on the Website is the property of the Company, or the persons who gave the consent to its usage to the Company.

4.2. It is prohibited to download or copy any content from the Website, unless the content is expressly intended for your personal use or unless the downloading of this content is not expressly permitted. However, in the case of the permitted downloading of content from the Website, the Candidate is obliged to adhere to all of the regulations concerning copyright or other rights of intellectual property.

4.3. It is strictly prohibited to modify, decipher, or otherwise manipulate with the software, source code of the Website or other information contained on the Website. The automated collection of information from the Website is prohibited.

5. Accessibility and changes of the content of the Website

5.1. The Company makes every effort to maintain the Website so as to ensure its full and uninterrupted operation. Occasionally, there may be interruptions due to maintenance, modifying the content, or technical issues. The Company is not hereby obliged to ensure uninterrupted access to the Website.

5.2. The Website and its functioning can be changed, suspended or terminated at any time. The Company may at any time, without prior notice, extend, limit or otherwise alter the extent of information posted on the Website.

6. Links to other webpages

6.1. In order to expand the services provided, the Website contains links to third-party webpages. The Company is not responsible for the content of these third-party webpages listed on the Website. Visiting these websites is at the Candidates’ own risk.

6.2. If the Candidate wishes to add a link to a third-party webpage, he / she is required to send the Company a preliminary notice to the e-mail address info@grafton.hu in the wording in which he / she wishes it to be posted on the Website. The Company reserves the right not to give consent to post such link, or to withdraw previously granted consent at any time and remove such link from the Website.

6.3. In order to better identify the needs of visitors of the Website, and for the Company to provide better recruitment services to companies, aggregated statistical and other related information about visitors of the Website may be collected, and this information may be shared with other selected third parties. This information may be collected using the information provided by the Candidates, but this information is anonymized, i.e. third parties are not able to establish the Candidate's identity or otherwise identify the Candidate.

7. Personal data

All personal data of natural persons will be processed in accordance with the Rules for the protection of personal data.

8. Cookies

The Website uses cookies. A cookie is a simple text file (usually only a few kilobytes large) that the Website sends to the web browser of the Candidate when the Candidate visits the Website. Cookie allows the Website to record information about the Candidate’s visit to the Website, such as his / her preferred language or other individual settings. Cookies are important. 9. Termination

The Company is entitled to prevent the Candidate from accessing the Website or completely cancel his / her registration without any compensation and without needing to give a reason. A Candidate has no legal right to use the Website.

10. Final provisions

10.1. If any provision of these TC becomes invalid or unenforceable, its invalidity or unenforceability will in no way affect the validity and enforceability of other provisions that remain in full force and effect.

10.2. These TC are governed by Hungarian law. Any disputes that may arise under or in connection with these TC will be settled by the competent Hungarian courts.
